Professional DIamond Stone Tools (PRO-DST) is pleased to offer its customers a broad array of outstanding products and services to support your stone fabrication needs. At all times it is the intent of PRO-DST to make available to customers the products they want, at competitive pricing, with little or no lead time, and through channels that they find convenient.

The following Terms and Conditions outline requirements that must exist between PRO-DST and our customers to ensure that both our interests are protected. If you have any questions or concerns we encourage you to contact us directly via phone or email.

The Terms and Conditions presented here are subject to update on our website, www.prodstsupply.com, and our website Terms and Conditions of Sale are hereby incorporated by reference. Our Terms and Conditions apply to all purchases and sales of items offered herein, and your purchase indicates your acceptance of our Terms and Conditions of Sale in effect as of the date of purchase. We disclaim any other Terms and Conditions contained in any customer purchase order, order form, or otherwise unless expressly agreed to by us in writing. Purchase orders must be strictly in conformity with these Terms and Conditions; inconsistent or conflicting terms in any purchase order or sale acknowledgment are rejected and shall be controlled by these Terms and Conditions unless agreed to by the customer and PRO-DST in a separate mutual writing. Additional terms are not binding unless agreed to by an officer of PRO-DST in a separate writing. We reserve the right to decline fulfilling orders at our discretion.

Our Catalogs of products, including www.prodstsupply.com, (the “PRO-DST Catalogs”) constitute original works and selections and arrangements of data compiled by PRO-DST, and are protected works and compilations under the U.S. Copyright Act. All rights in PRO-DST Catalogs are reserved by PRE-DST. The use of PRO-DST Catalogs is allowed solely to assist you in reviewing and purchasing products from PRO-DST.

Customers transacting e-commerce business with PRO-DST on our website and/or via third party platforms are subject to the website General and Catalog Terms of Use, and other limitations appearing on and applicable to visitors and users of our website, found at www.prodstsupply.com.

www.prodstsupply.com identifies those products which are most often required by our customers. PRO-DST stocks over 95% of the items represented on our website, however some non-stock items are occasionally listed to represent a full range of commercial availability (phasing that way so). In-stock items will be shipped no later than on the next business day from a PRO-DST warehouse, while non-stock or special items will be shipped depending on availability. The availability of product may vary amongst our branch locations, and PRO-DST reserves the right to ship product to customers from any of its locations, or to advise customers of extended delivery times depending on the location where the product is requested. Please ask PRO-DST about all of your stone fabrication needs, even if they aren’t listed on our website. Our goal is to have the products represented on our website in stock, in sufficient quantity, and available when you need them.

Items can be returned only with the prior approval of Professional Diamond Stone Tools.
Except as otherwise noted in our refund policy, no items will be accepted for return without prior approval from an authorized representative of PRO-DST. To discuss a return, you must call PRO-DST at (602) 268-3361 or email sales@prodstsupply.com. Returns will not be accepted without a Return Authorization number. Return shipments must include a copy of your invoice and/or packing slip. All merchandise must be returned in its original packaging and condition. Any claims for discrepancies in shipment must be made within 7 days of receipt of merchandise. C.O.D. returns will not be accepted. Shipping charges for returned items must be prepaid. A re-stocking charge may be applied. Restrictions may apply to heat treated product and custom orders.

Product: Prices and charges on our website are effective immediately when displayed on our website and are subject to change without notice. All prices are quoted in U.S. dollars. We reserve the right to pass on any surcharges or impose purchase restrictions or limits at any time. Except where noted otherwise, the List Price or Base Price displayed for products on most items represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price or Base Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the List Price or Suggested Price may represent “open-stock” prices, which means the aggregate of the manufacturer’s estimated or suggested retail price for each of the items included in the set.

Charges: All orders are subject to applicable shipping, freight, taxes and processing charges. Estimated freight charges will be provided at the time your order is placed. See “Delivery” below for more information about applicable shipping charges.

Carrier Surcharges: Carriers may impose surcharges, which vary by carrier and may change at the carrier’s discretion. PRO-DST will pass on the surcharge.

Delivery: Orders weighing less than 150 pounds will be shipped via UPS. Orders weighing more than 150 pounds will be shipped via one of several PRO-DST chosen carriers depending on the shipping location. All orders are shipped F.O.B. from a PRO-DST distribution facility. Title and risk of loss pass to our customer on delivery to the common carrier or upon customer pickup. Orders placed on Friday (after our local cut-off time) and on weekends or holidays will be shipped on the next regular business day. See Warranties-Limited Liability.

Shipping charges for orders weighing less than 150 pounds are determined by using UPS Small Parcel for most shipments. Customers may select UPS Red, Blue or Ground options. Shipping charges for non-stocking orders, orders over 150 lbs. and premium shipping services will be subject to the carrier’s published rates. In some cases, shipping charges may be less than or greater than PRO-DST’s actual cost to process and ship.

Hazardous Materials: Hazardous materials may require special handling for delivery, are not service level guaranteed, and may be subject to local, state, and federal regulations which may delay or prohibit shipments. Hazardous materials will not be shipped to Alaska or Hawaii or exported outside of the contiguous United States.

Damaged or Lost Shipments: Ensure to check your order immediately upon arrival. All damages must be noted on delivery receipt. All shortages and damages must be called into (602) 268-3361 and emailed to sales@prodstsupply.com within 7 calendar days.

Payments: Payments are due upon ordering. For your convenience we accept Visa, MasterCard, American Express, Discover and Paypal.

The specifications and data in our PRO-DST Catalogs and on our website are provided by the manufacturer and/or accrediting body and are provided for your convenience. We have taken reasonable steps to ensure that this data is accurate but we make no guarantees on the information and make no implied or expressed warranties on such information. Cross-reference comparisons are provided for your information and review, though they do not imply that products are available or perfectly comparable, nor are they represented or warranted as functional or performance equivalents.

Catalog Errors: Though the information in this catalog has been carefully checked for accuracy, errors and omissions occasionally occur and therefore are subject to correction. We regret any inconvenience.

It is the policy of Professional Diamond Stone Tools to offer only the highest quality products supplied by established and approved vendors. We assume no liability beyond replacing defective merchandise and refunding the purchase price, providing a claim is processed within a reasonable amount of time. We will not allow claims for consequential damage, transportation charges, or for labor or other expenses incurred in removing defective products or installing replacement material.

WE HEREBY DISCLAIM ALL WARRANTIES OF FITNESS, FITNESS FOR PURPOSE, AND/OR MERCHANTABILITY, EXPRESS OR IMPLIED, OTHER THAN THE LIMITED RETURN AND REPLACEMENT RIGHT SET FORTH ABOVE ANY WARRANTIES WHICH THE MANUFACTURER MAY SUPPLY.

PRO-DST shall not be responsible for computer or electronic interruptions, mechanical or electrical breakdowns, strikes, labor slowdowns, war, terrorism, riots, severe weather conditions, natural disasters, acts of God or any other forces beyond the reasonable control of PRO-DST, LTL shipments and other non-scheduled carriers, branch shipments (due to earlier pickups), back ordered items, replacement orders, new accounts (first order), orders requiring credit review, and supplier manufacturing deficiencies.

Compliance with Laws: Some products may be obtained from multiple supply sources located throughout the United States, or internationally, and shipped directly to the customer without sending the item through PRO-DST. Many states and localities have codes and regulations governing sale, offering for sale, distribution, construction, installation and use of products for certain purposes and/or containing certain regulated substances, which may vary from those in neighboring areas. PRO-DST relies upon information provided by the supplier of these products to ensure they are compliant with the laws of the jurisdiction into which the product is shipped. The information provided by the supplier as to the ability of the product to be sold or distributed in any particular jurisdiction is believed by PRO-DST to be accurate. PRO-DST, however, shall not be responsible for how products are used or installed or for the product’s conformance to regional, state, or local codes or regulations. PRO-DST does not guarantee compliance with any law and assumes no responsibility for how the items are used or installed. The Customer has the sole responsibility for compliance with all applicable codes, regulations and laws and before purchase and use of the product must review and ensure full compliance with such codes, regulations and laws concerning the use or installation of the products.

Customer shall have no right to copy or use any of the intellectual property of PRO-DST or its suppliers without PRO-DST’s permission. All materials contained in PRO-DST’s catalog, and PRO-DST’s website, are subject to the ownership rights of PRO-DST and its suppliers.

All transactions shall be governed by the laws of the State of Arizona without regard to any conflict of law principles that would require the application of the laws of any other jurisdiction, and venue shall be in Maricopa County, Phoenix, Arizona.
